This is the second time in the same 'private respite' that Malaika was hospitalized for "hurting down there." Being found with a UTI both times. This time Malaika Gave a Specific Disclosure out of her own mouth with people that she loves and trusts, which is documented as preserved evidence. Nicole Montzingo, Nicole McConn, Alexander M. Calero & others chose to ignore, shift blame and focus. Conceal & Cover. Then of course, retaliate by misusing and undermining the integrity of the legal system. San Diego Superior Court Judge Recuses herself.
Let me walk you through what happened in this Marsden hearing, and why it matters.”
Judge Alexander M. Calero lacks the ability and intelligence this judge displayed as she voluntarily recused herself despite her cleanup and word play.
Alexander M. Calero would rather self adjudicate his own disqualification, write a 7 page order to strike my motion while simultaneously claiming improper service.
A Marsden hearing is supposed to be a protected space where a parent or defendant can ask the court to replace a court-appointed attorney who isn’t doing their job. It’s private, it’s recorded, and it’s meant to protect our constitutional right to effective assistance of counsel.
In my case, I asked for a Marsden hearing because my attorney wasn’t fighting for me or my children, and he wasn’t defending our constitutional rights. He even told me—on the record—that my First Amendment rights were ‘not absolute,’ even though I wasn’t slandering anyone and was simply speaking out about my own case and my own children.
During this hearing, my attorney started explaining my position about jurisdiction. I had made it clear that I never contracted with CPS, I never consented to their authority, and I never entered any agreement that would give them lawful jurisdiction over me or my children. There was no abuse, no neglect—nothing that would legally give the State power over us.
All I ever did was attend one voluntary class, which I completed and have the certificate for, and I left when I realized the agenda wasn’t to help families but to separate them. And because it was voluntary, I was free to leave at any time.
So during the Marsden hearing, when the topic of contracts and jurisdiction came up, the judge suddenly paused the hearing and took a break. When she came back, she said she was recusing herself.
Now here’s where it becomes important.
She had already disclosed previously that she once taught a class where my attorney had been a student. She had already said this earlier in the case—more than once—and she still presided over the matter. She never saw it as a conflict before.
So why recuse now?
The only thing that changed was that the discussion finally put jurisdictional defects on the record—issues that go to the foundation of the case itself. And immediately after that, the judge stepped away and removed herself, using a disclosure that wasn’t new and wasn’t something she considered disqualifying before.
To the public, to families going through this system, this is why I want to share this video:
When a judge presides over a case multiple times with no issue, but suddenly recuses only after jurisdiction and constitutional rights are brought into the spotlight, it raises real questions about the fairness, transparency, and motives inside these proceedings.
How is it that the conflict didn’t matter at the beginning—but suddenly mattered right after the constitutional arguments were raised?
I’m sharing this because families deserve to understand what happens behind closed doors in dependency court. These hearings affect our children, our rights, and our lives. And when the system reacts this way the moment the law is brought up, people deserve to see it for themselves and decide what they think.
This is the purpose of this video:
to educate, to inform, and to show exactly what occurred—so that the public can watch, learn, and make their own conclusions about what took place in this courtroom. Also I want people to learn from my own mistakes, especially during the earlier stages of this case as I am merely learning as I go. I need to research further, but I think i also made a mistake by agreeing to being transferred to a new judge after she recused herself.
